Welcome to HastingsNow.com and Soundbites. These Terms of Service (“Terms”) govern your access to and use of our websites, pages, content, tools, and related services.
HastingsNow.com is operated by Local Pigeon, Inc. By using our services, you agree to these Terms.
If you do not agree, do not use the services.
## 1. Eligibility
You may use our services only if you can form a binding agreement with us and your use complies with applicable law.
If you submit content on behalf of a business, nonprofit, agency, or other organization, you represent that you have authority to do so.
## 2. Accounts and access
Some features may require an account, sign-in link, password, or organization-specific access.
You are responsible for:
- maintaining the confidentiality of your credentials
- restricting unauthorized use of your account or access links
- notifying us promptly if you believe your account or access link has been compromised
We may suspend or terminate access where needed for security, legal, or policy reasons.
## 3. What the services do
HastingsNow may include:
- editorial and community content
- Soundbites voice-note and audio submission tools
- transcripts, previews, and public post pages
- newsletters and signup forms
- embeds, archives, rankings, and category pages
- sponsored or paid promotional placements
We may add, change, pause, or discontinue features at any time.
## 4. User submissions and Soundbites
If you submit audio, text, images, video, links, or other material, you represent and warrant that:
- you own the content or have all rights needed to submit it
- you have permission from any person whose voice, likeness, or content appears in it
- your submission is accurate to the best of your knowledge
- your submission does not violate law, privacy rights, publicity rights, copyright, trademark, or contract rights
- your submission is not deceptive, defamatory, threatening, hateful, or unlawful
For Soundbites and similar submission tools, you also agree that we may:
- record or receive the audio you submit
- generate transcripts, drafts, snippets, subtitles, and derivative media
- edit for length, clarity, formatting, and publication needs
- label, review, hold, reject, limit distribution, or publish the content
- add one or more CTAs, labels, or trust indicators where appropriate
Submission does not guarantee publication.
## 5. License you grant us
You retain ownership of the content you submit, but you grant Local Pigeon, Inc. a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to:
- host
- store
- reproduce
- adapt
- edit
- transcribe
- publish
- distribute
- display
- perform
- promote
- create derivative works from
your submitted content for the purpose of operating, improving, marketing, and distributing HastingsNow and related products and services.
This license continues for any content already published or distributed until commercially reasonable archival, backup, and operational uses end.
## 6. Moderation and publication decisions
We may, in our sole discretion, review, label, correct, limit, rank, downrank, remove, hide, reject, archive, or publish content.
We may take action for reasons including:
- safety
- legality
- accuracy concerns
- duplication
- spam
- impersonation
- rights complaints
- sponsor-labeling issues
- editorial fit
- technical failures
## 7. Sponsored content and rankings
Some placements or distributions may be paid or sponsored. We aim to label sponsored content clearly.
Not all surfaces are purely chronological. We may use editorial judgment and system signals—such as freshness, locality, relevance, verification, safety, category fit, and community response—to rank or distribute content.
Paid placement does not guarantee publication of any specific claim and does not override our moderation rules.
## 8. Prohibited conduct
You may not:
- impersonate another person or organization
- submit content you do not have the right to use
- upload malware, spam, or malicious code
- scrape or copy the service at scale without permission
- interfere with security or normal platform operation
- harass, threaten, dox, or exploit others
- submit unlawful, defamatory, fraudulent, or deceptive content
- upload or distribute unauthorized synthetic voice or likeness content
- misuse the service for emergency communications
## 9. Intellectual property
All HastingsNow.com content, except user-submitted content retained by its owners, is owned by Local Pigeon, Inc. or its licensors and is protected by intellectual property law.
You may not copy, republish, scrape, or commercially exploit our materials except as allowed by law or with our written permission.

Our services may contain links to third-party websites, social platforms, schedulers, payment tools, maps, or embeds. We are not responsible for third-party content, policies, or performance.
## 12. No professional or emergency advice
HastingsNow content may include community updates, self-reported claims, sponsored content, and AI-assisted outputs.
Unless we expressly state otherwise, HastingsNow does not provide medical, legal, financial, or emergency-response advice. Do not rely on the service as a substitute for professional advice or emergency services.

To the fullest extent permitted by law, Local Pigeon, Inc. and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to your use of the services.
If liability cannot be fully disclaimed, our aggregate liability will be limited to the greater of:
- the amount you paid us in the prior 12 months for the relevant service, or
- $100
## 15. Indemnity
You agree to defend, indemnify, and hold harmless Local Pigeon, Inc. and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, judgments, losses, and expenses arising out of:
- your content
- your misuse of the services
- your breach of these Terms
- your violation of law or third-party rights
## 16. Governing law and venue
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the services must be brought in the state or federal courts located in Minnesota, and you consent to personal jurisdiction and venue there.
## 17. Changes
We may change these Terms from time to time. The updated Terms will be posted here with a revised “Last updated” date. Your continued use of the services after changes become effective means you accept the updated Terms.
