Welcome to HastingsNow.com.
These Terms of Service (“Terms”) govern your access to and use of HastingsNow.com, Soundbites, Local Pigeon Messenger, Brand Channels, Local Updates, related pages, content, tools, and services.
These services are operated by Local Pigeon, LLC, doing business as HastingsNow.com (“HastingsNow,” “we,” “us,” or “our”).
By accessing or using our services, you agree to these Terms.
If you do not agree, do not use the services.
## 1. Eligibility
You may use our services only when:
- you can form a binding agreement with us
- your use complies with applicable law
- you follow these Terms and related policies
If you are under the age of legal majority where you live, you may use the services only with the permission and supervision of a parent or legal guardian.
Our services are not directed to children under 13.
If you submit content or manage a Brand Channel on behalf of a business, nonprofit, government agency, school, campaign, association, or other organization, you represent that you have authority to do so.
## 2. Accounts and access
Some features may require:
- an account
- a sign-in link
- a password
- an organization-specific link
- an invitation
- identity or authority verification
You are responsible for:
- maintaining the confidentiality of your credentials
- restricting unauthorized use of your account or access links
- providing reasonably accurate information
- notifying us promptly if you believe access has been compromised
We may suspend, restrict, or terminate access when reasonably necessary for security, legal, privacy, payment, abuse-prevention, or policy reasons.
## 3. What the services may include
HastingsNow may provide:
- editorial and community information
- Soundbite recording and submission tools
- Local Pigeon Messenger
- transcripts, excerpts, and public post pages
- Local Updates
- Brand Channels
- business and organization information
- events, jobs, deals, and announcements
- newsletters
- forms
- embeds
- archives
- categories
- search and discovery tools
- editorial rankings and LOCAL 10
- sponsored or paid promotional placements
- photography, audio, video, research, editing, and publishing services
We may add, change, pause, restrict, or discontinue features at any time.
## 4. User and organization submissions
When you submit audio, text, photographs, video, links, organization information, or other material, you represent and warrant that:
- you own the material or have all rights needed to submit it
- you have authority to submit information on behalf of any identified organization
- you have permission from any identifiable person whose voice, likeness, or content appears
- your submission is accurate to the best of your knowledge
- your submission does not violate privacy, publicity, copyright, trademark, contract, or other legal rights
- your submission is not deceptive, defamatory, threatening, hateful, fraudulent, or unlawful
- public contact information you submit is authorized for public use
For Soundbites and related tools, you agree that we may:
- record or receive submitted audio or video
- generate transcripts, subtitles, summaries, drafts, excerpts, and derivative media
- edit for length, clarity, readability, format, and publication
- review, label, hold, reject, correct, limit, archive, or publish the material
- attach calls to action, source labels, trust indicators, or sponsorship labels
- distribute approved content through HastingsNow and related channels
Submission does not guarantee publication, ranking, distribution, or inclusion in LOCAL 10.
## 5. Public business and organization information
We may publish business, organization, civic, and community information obtained from:
- authorized representatives
- public websites
- public records
- public directories
- public social-media pages
- press releases
- event materials
- interviews
- direct reporting
- previous submissions
- other identified sources
Public availability does not necessarily mean every field is appropriate for republication.
We do not intend to publish a residential address, personal telephone number, or private email address as public business contact information unless the affected person or an authorized organization representative expressly approves that information for public display.
If you believe public information is inaccurate, outdated, private, or improperly attributed, contact:
We may temporarily hide information while reviewing a credible privacy or correction request.
## 6. License you grant us
You retain ownership of content you submit.
You grant Local Pigeon, LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:
- host
- store
- reproduce
- adapt
- edit
- transcribe
- translate
- publish
- distribute
- display
- perform
- promote
- create derivative works from
your submitted content for the purpose of operating, providing, improving, documenting, promoting, and distributing HastingsNow and related Local Pigeon services.
This license applies only to content you have the right to submit.
For content already published or distributed, the license continues for as long as reasonably necessary to maintain archives, backups, previously created media, legal records, and ordinary operational uses.
When reasonably practical, we will honor valid removal or withdrawal requests in accordance with our policies, legal obligations, existing third-party distribution, and archival needs.
## 7. Moderation and publication decisions
We may, in our discretion:
- review
- edit
- label
- verify
- correct
- limit distribution
- rank
- downrank
- hold
- reject
- remove
- hide
- archive
- publish
content or information.
Reasons may include:
- privacy
- safety
- legality
- accuracy concerns
- outdated information
- duplication
- spam
- impersonation
- rights complaints
- sponsor-labeling issues
- editorial fit
- resident usefulness
- technical failures
- expiration
- violations of these Terms
We do not guarantee that submitted or publicly sourced information will be published or remain published.
## 8. Trust and verification
A “Verified Local Source” label means that we have reasonably confirmed identity, organizational authority, or local connection.
It does not mean that every claim made by that source has been independently verified.
“Reviewed by HastingsNow” means that a human reviewer checked the material under our review process. It does not mean exhaustive fact-checking.
Payment does not purchase verification or editorial endorsement.
## 9. Sponsored content, rankings, and LOCAL 10
Some production, placement, or distribution may be paid or sponsored.
We aim to label sponsored or paid material clearly.
Not every HastingsNow surface is chronological.
We may consider:
- usefulness
- freshness
- timeliness
- local relevance
- verification
- source clarity
- safety
- category fit
- expiration
- editorial judgment
- limited aggregate engagement signals
Paid placement does not guarantee publication of a particular claim and does not override our privacy, correction, moderation, or safety rules.
Payment does not guarantee:
- organic ranking
- favorable editorial treatment
- LOCAL 10 selection
- permanent publication
- immunity from correction or removal
## 10. Purchases and paid services
Certain services may require payment.
The applicable offer, price, scope, and service period will be described at purchase, on an invoice, or in a separate written agreement.
Unless expressly disclosed and authorized:
- payments are not automatically recurring
- a one-time payment does not create an ongoing subscription
- no long-term contract is created
- continuation services require a separate agreement or purchase
Amounts paid for work already performed, delivered media, completed production, reserved scheduling, or nonrefundable third-party costs may not be refundable.
Any refund or cancellation terms presented with a specific offer control over this general section.
Failure to pay an agreed amount may result in suspension of paid services or withholding of undelivered work.
Payment does not purchase editorial endorsement, verification, or guaranteed organic placement.
## 11. Prohibited conduct
You may not:
- impersonate another person or organization
- falsely claim authority to represent an organization
- submit material you do not have the right to use
- publish another person’s private information without authorization
- harass, threaten, stalk, dox, or exploit others
- upload malware, spam, or malicious code
- scrape or copy the services at scale without permission
- interfere with security or normal operation
- attempt unauthorized access
- manipulate engagement or ranking systems
- submit unlawful, defamatory, fraudulent, or deceptive content
- upload unauthorized synthetic voice, likeness, or impersonation content
- use the service as a substitute for emergency communications
- misrepresent sponsored material as independent editorial content
## 12. Intellectual property
Except for user-submitted material retained by its owner, HastingsNow content and services—including designs, code, branding, graphics, original photography, original video, reports, editorial material, databases, and software—are owned by Local Pigeon, LLC or its licensors and are protected by applicable intellectual-property laws.
You may not copy, republish, scrape, distribute, sell, modify, reverse engineer, or commercially exploit our materials except:
- with written permission
- as expressly allowed by a separate agreement
- as permitted by applicable law
## 13. Copyright notices
If you believe material on HastingsNow infringes your copyright, send a written notice to:

Please include:
- your name and contact information
- identification of the copyrighted work
- identification and location of the allegedly infringing material
- the relevant URL
- a good-faith statement that the use is not authorized
- a statement under penalty of perjury that the information is accurate and that you are authorized to act
- your physical or electronic signature
We may remove or restrict material while reviewing a credible copyright complaint.
We may request additional information and may provide the complaint to the affected submitter.
This notice procedure does not by itself represent that Local Pigeon, LLC has qualified for or is relying upon every available statutory safe harbor.
If we register a designated DMCA agent, we will publish the agent’s current information and maintain the required registration.
## 14. Repeat infringement
We may suspend or terminate accounts or organizational access associated with repeated or serious infringement of intellectual-property rights.
We may consider:
- the number and credibility of complaints
- counter-notices or responses
- apparent good faith
- the severity of the conduct
- applicable legal obligations
## 15. Third-party services and links
Our services may contain links to or embeds from third-party:
- websites
- social platforms
- schedulers
- payment tools
- maps
- media players
- newsletter providers
- analytics services
We are not responsible for their independent content, availability, security, terms, or privacy practices.
Your interactions with a third party are governed by that party’s policies.
## 16. No professional or emergency advice
HastingsNow content may include:
- self-reported statements
- public information
- community updates
- sponsored material
- AI-assisted outputs
- summaries of external sources
Unless expressly stated otherwise, HastingsNow does not provide medical, legal, financial, or emergency-response advice.
Do not rely on the services as a substitute for qualified professional advice or emergency services.
## 17. Disclaimers
The services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim warranties of:
- merchantability
- fitness for a particular purpose
- non-infringement
- accuracy
- completeness
- uninterrupted availability
- error-free operation
Local information may change quickly. Businesses, organizations, events, prices, hours, availability, and public conditions may change without notice.
Users should confirm time-sensitive or important information directly with the relevant source.
## 18. Limitation of liability
To the fullest extent permitted by law, Local Pigeon, LLC and its members, managers, affiliates, employees, contractors, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to use of the services.
If liability cannot be fully disclaimed, our total aggregate liability for a claim will be limited to the greater of:
- the amount you paid us during the 12 months preceding the event giving rise to the claim for the relevant service
- $100
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitations apply only to the extent permitted by law.
## 19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Local Pigeon, LLC and its members, managers, affiliates, employees, contractors, agents, and licensors from claims, liabilities, damages, judgments, losses, and reasonable expenses arising from:
- content you submit
- your misuse of the services
- your breach of these Terms
- your violation of applicable law
- your violation of another person’s rights
- your false claim of authority to represent an organization
This section does not require indemnification for conduct caused solely by Local Pigeon, LLC’s own unlawful actions where indemnification would be prohibited by law.
## 20. Suspension and termination
We may suspend or terminate access for:
- material violations of these Terms
- fraud
- threats or harassment
- unlawful conduct
- security risks
- repeated infringement
- nonpayment for paid services
- misuse of organization access
- conduct that creates substantial risk to users, organizations, the public, or our services
You may stop using the services at any time.
Sections that by their nature should survive termination—including licenses for previously published content, intellectual property, disclaimers, limitations, indemnification, and dispute provisions—will survive.
## 21. Governing law and venue
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules.
Any dispute arising from these Terms or the services must be brought in a state or federal court with appropriate jurisdiction in Minnesota, unless applicable law requires otherwise.
You consent to personal jurisdiction and venue in those courts.
## 22. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable when legally permitted.
## 23. No waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
## 24. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent.
We may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or transfer of the services.
## 25. Entire agreement
These Terms, together with our Privacy Policy and any offer-specific or written service agreement, constitute the applicable agreement between you and Local Pigeon, LLC regarding the services.
If a signed or offer-specific agreement directly conflicts with these Terms, the more specific agreement controls for that service.
## 26. Changes to these Terms
We may update these Terms from time to time.
We will post the revised Terms and change the “Last updated” date.
When legally required, we will provide additional notice of material changes.
Continued use of the services after revised Terms take effect constitutes acceptance of the revised Terms.
